Job Description
Works on complex legal problems that significantly impact the objectives and operating results of the organization, with a focus on legal claims and risk management matters. Manages difficult litigation related issues where negative outcomes could adversely impact the organization. Provides leadership to administrative legal staff. Provides counsel to the organization's human resources department regarding HR litigation and compliance issues. Ability to manage litigation, insurance and health care regulatory issues. Requires provide experience and expertise in legal areas important to the organization.

Education

J.D. degree from an accredited law school.

Experience

At least four years general practice experience, with prior experience in healthcare law, trial and

risk management practice preferred. Proficiency with medical terminology preferred.

Skills

  • Ability to efficiently research issues and write opinions reducing complex issues to non-technical language intelligible to laypersons.
  • Skill in using a computer and a variety of personal productivity applications

Licensures, Certifications

Membership in Maryland Bar

  • Demonstrates competency in the delivery of care and applies the knowledge to meet age-specific needs if applicable.

Principal Duties and Responsibilities

  • In coordination with the General Counsel, supervises the work of outside litigation attorneys representing GBMC. Actively directs litigation strategy and manages litigation expense. Reviews and approves litigation bills submitted.
  • Works closely with Quality Department staff to identify opportunities to improve patient care and reduce suboptimal clinical outcomes. Identifies learnings from claims management and effectively communicates them to relevant GBMC stakeholders in order to improve patient care, and reduce claims exposure to the organization and its clinical staff.

  • Recommends settlement and litigation positions to the claims committee of the board, and to senior management. Represents GBMC at settlement conferences and mediations.
  • Researches and advises senior management, physician leaders and other staff on legal issues, including claims, risk management, patient care, safety and employment related issues.

  • Administers incident reporting system and investigates and evaluates events with significant liability exposure as identified from incident reports, performance improvement, complaint tracking referrals, and other sources.

  • Participates in the formulation of policies and procedures for the containment of risk exposures and enhancement of patient safety and advises operational departments and policy making groups on measures intended to reduce risk exposures, including staff education programs.

  • Writes, revises and reviews employment contracts, and employment policies and procedures. Composes legal memoranda, opinions and general correspondence
  • Investigates incidents, complaints and other patient care issues and advises on appropriate responses.

  • Participates in design and conduct of legal and risk management educational sessions. Conducts or directs educational programs for professional staff.
